Welcome to OptiBIM (accessible via optibim.in, hereinafter referred to as the "Platform" or "Software"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and OptiBIM ("we", "us", or "our"). By creating an account via our authentication provider (Clerk), accessing, or using our automated structural engineering audit and 3D visualization services, you explicitly agree to be bound by these Terms.
01 Nature of Service and Assistive Tool Clause
OptiBIM provides automated design checking, Excel-logic processing, data organization, and 3D structural rendering tools designed to assist engineering workflows. The Platform parses user-provided inputs against structural code logic interpretations.
You explicitly understand and agree that:
- aOptiBIM is an assistive educational and administrative software tool. It does not constitute professional engineering, architectural, or structural consulting advice.
- bThe outputs, reports, and 3D visualizations generated by the Platform are entirely dependent on user-provided inputs and mathematical interpretations of standard codes. They are not a replacement for professional human judgment.
02 Subscriptions, Billing & Free Trial
- aPaid subscriptions (monthly or annual) are billed in advance and renew automatically through our payment processor, Razorpay, until cancelled.
- bNew accounts may be eligible for a one-time, no-card-required free trial of the Professional plan (currently 14 days). One trial is permitted per account, ever.
- cIf a trial ends without upgrading to a paid plan, your account automatically reverts to the Free plan — no card is charged, since none was collected during the trial.
- dYou may cancel a paid subscription at any time from your Account Settings. Cancellation stops future renewal charges; it does not immediately revoke access. Full details on what happens to your access and payments upon cancellation are set out in our Cancellation & Refund Policy, which forms part of these Terms.
- eWe may change subscription pricing or plan features from time to time. Where reasonably possible, we'll give advance notice before a price change takes effect for existing subscribers.
03 Absolute Limitation of Liability & Disclaimer
- aThe Software, outputs, and reports are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.
- bTo the maximum extent permitted by applicable law, OptiBIM, its developers, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of profits, data, use, goodwill, or other intangible losses resulting from the use of or inability to use the Platform.
- cWe hold absolutely no liability for structural failures, design miscalculations, material wastage, project delays, financial losses, or erroneous audits resulting from user input errors, software glitches, or re-interpretations of building codes.
- dEvery reinforced concrete, steel, or structural design processed through the Platform must be manually checked, verified, and formally signed off by a licensed, chartered structural engineer before concrete pouring, construction, or formal municipal submission.
OptiBIM Pro is an assistive engineering tool, not a substitute for a licensed structural engineer's sign-off. All outputs require professional verification before use in construction.
04 User Responsibilities & Account Security
- aAuthentication and session security are handled securely via Clerk. You are solely responsible for maintaining the confidentiality of your login credentials and OTP codes.
- bYou agree not to attempt to reverse-engineer, decompile, scrape, or inject malicious payloads into our FastAPI backend, calculation engine, or Three.js visual components. Any such attempt will result in immediate termination of service without a refund.
05 Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any legal actions or proceedings arising under these Terms shall be subject exclusively to the jurisdiction of the courts located in Kolkata, West Bengal, India.
